Tsukuba AI Lab Co., Ltd. ("we," "us," or "our") establishes these Terms of Service (these "Terms") as the conditions for using the website https://tsukuba-ai-lab.com, including all pages under that domain (the "Site"), which we operate. These Terms constitute the terms of the agreement between us and each person who uses the Site (a "User" or "you") concerning the use of the Site. Please read these Terms before using the Site.
Article 1 (Scope)
- These Terms apply to all relationships between us and Users relating to the use of the Site.
- If we establish separate terms for a specific page or service on the Site, those separate terms form part of these Terms. In the event of a conflict between these Terms and such separate terms, the separate terms prevail with respect to that page or service.
- These Terms do not apply to any website we operate other than the Site (including hackernews.jp). The terms of use for those websites are as stated on each respective website.
Article 2 (Information on the Site)
- We make no warranty as to the accuracy, timeliness, completeness, or fitness for a particular purpose of any information published on the Site (including technical articles, sample code, figures, numerical data, and descriptions of third-party services).
- The technical articles and sample code on the Site are provided for explanatory purposes. We do not warrant that they will operate properly, that they are secure, or that they do not infringe the rights of any third party. Whether to incorporate them into your systems or business is for you to decide, at your own discretion and responsibility, after your own verification.
- Descriptions of laws, regulations, public systems, and the specifications or pricing of third-party services are based on information available at the time of writing and may not reflect subsequent amendments or changes.
- Articles on the Site are intended to provide general information and do not constitute legal, tax, accounting, investment, or other professional advice on any specific matter.
- Our liability for any damage you incur in connection with the use of the Site is as set forth in Article 3.
Article 3 (Limitation of Liability)
- If you incur damage due to the willful misconduct or gross negligence of us, our representatives, or our employees or other persons we use, we will compensate you for such damage in accordance with applicable law.
- If you incur damage due to our negligence (excluding gross negligence), the damages we compensate are limited to direct and actual damage that would ordinarily arise, and do not include damage arising from special circumstances, lost profits, or damage resulting from loss of data. This paragraph applies only to acts involving negligence, other than gross negligence, on the part of us, our representatives, or our employees or other persons we use.
Article 4 (Copyright and Intellectual Property)
- Copyright and other intellectual property rights in the text, images, figures, logos, and other content published on the Site belong to us or to the respective rights holders.
- You may quote content from the Site to the extent that the requirements for quotation under the Copyright Act of Japan are met. When quoting, please indicate the source by stating the article title, the author name shown in the article, and the URL of the article.
- Except as provided in paragraph 2 and the following paragraph, and except as permitted under the Copyright Act of Japan or other applicable laws, you must obtain our prior written permission (including by email) to republish, reproduce, adapt, translate, redistribute, or otherwise use content from the Site.
- Unless a different license is indicated in the relevant article, sample code published on the Site in which we hold the copyright is dedicated under CC0 1.0 Universal. You may use it freely, for commercial or non-commercial purposes, without our permission.
- Rights in third-party works quoted or introduced on the Site (including code in which a third party holds the copyright) belong to the respective third parties.
- Company names, product names, and service names mentioned on the Site are trademarks or registered trademarks of their respective owners. Except as disclosed under Article 6, such mentions do not imply any partnership between us and those companies or any endorsement by them.
- If you believe that any content on the Site infringes copyright or any other right, please contact us using the details in Article 14. We will review the facts and take appropriate action.
Article 5 (Links)
- You are generally free to link to the Site. However, we do not permit links that:
- are intended to defame us or any third party;
- are placed on a website containing content that violates laws or public order and morals;
- are presented in a manner that may suggest a partnership with us; or
- display content from the Site as if it were part of another website (such as by framing).
- Third-party websites linked from the Site are not under our control. The content of linked websites and the services offered on them are provided under the responsibility of their respective operators. Please check the terms of use of each linked website with its operator. Our liability for any damage you incur in connection with links placed on the Site is as set forth in Article 3.
Article 6 (Advertising and Affiliate Links)
- Articles on the Site may contain advertisements and affiliate links. An "affiliate link" is a link to a third party's product or service through which we receive a referral fee or other economic benefit when a sign-up, purchase, or similar action is made via that link.
- Any article containing advertisements or affiliate links will state so in a position where readers can easily notice it, such as at the beginning of the article. The same applies to articles we create at an advertiser's request and to articles we create after receiving free products or services or any other benefit.
- Whether we receive a referral fee does not change how we evaluate products or services in our articles. We do not describe any product or service that we have not actually used or tested as if we had used or tested it.
- We also follow the disclosure methods required by the terms of each affiliate or partner program in which we participate.
- Any contract for the purchase or use of an advertiser's or partner's product or service is formed between you and that advertiser or partner, and we are not a party to it. Please direct any inquiries about such products or services to their providers.
- If you notice anywhere on the Site where an advertising disclosure is unclear, please contact us using the details in Article 14.
Article 7 (Personal Information)
We handle personal information obtained through the Site (including information obtained through the contact form, access logs, and access analytics) in accordance with our separately established Privacy Policy (available in Japanese).
Article 8 (Prohibited Conduct)
- When using the Site, you must not:
- violate any law or public order and morals;
- infringe the copyright, trademark rights, or other intellectual property rights, or the reputation, credit, privacy, or other rights or interests, of us or any third party;
- republish, reproduce, adapt, translate, or redistribute content in violation of Article 4;
- place an excessive load on the Site's servers or network (including mass access or scraping by automated tools in such a manner);
- gain unauthorized access, conduct vulnerability testing without our permission, or otherwise interfere with the operation of the Site;
- transmit computer viruses or other harmful programs;
- submit false information through the contact form, or use the contact form for sales, solicitation, or sending unsolicited messages;
- alter our articles and publish them as if they represented our views; or
- engage in any other conduct comparable to the foregoing that we determine, on reasonable grounds, to be inappropriate.
- If we determine that a User has engaged in any of the conduct listed in the preceding paragraph, we may, without prior notice, restrict that User's access to the Site and take other necessary measures.
Article 9 (Changes, Suspension, and Termination of the Site)
We may, without prior notice, change the content of the Site, add, modify, or delete articles, or suspend or terminate the Site. Our liability for any damage you incur as a result is as set forth in Article 3.
Article 10 (Amendments to These Terms)
- We may amend these Terms in either of the following cases:
- the amendment conforms to the general interests of Users; or
- the amendment does not conflict with the purpose of the agreement concerning the use of the Site and is reasonable in light of the necessity of the amendment, the appropriateness of the amended content, and other circumstances relating to the amendment.
- When we amend these Terms, we will set an effective date for the amended Terms and, before that date, post on the Site a notice that these Terms will be amended, together with the content of the amended Terms and the effective date.
Article 11 (Severability)
Even if any provision of these Terms, or any part of it, is held invalid or unenforceable under the Consumer Contract Act of Japan or any other law, the remaining provisions of these Terms will continue in full force and effect.
Article 12 (Governing Law and Jurisdiction)
- These Terms are governed by and construed in accordance with the laws of Japan.
- The district court or summary court having jurisdiction over the location of our head office shall have exclusive agreed jurisdiction as the court of first instance over any dispute arising between us and a User in connection with the use of the Site.
Article 13 (Governing Language)
The Japanese version of these Terms is the official version. Any translation of these Terms that we provide (including this English version) is for reference only, and if there is any discrepancy between the Japanese version and a translation, the Japanese version prevails.
